Mybo Management (hereafter “Mybo”) provides the content published on this website (the “Site”) for the purpose of promoting its business activities.

Ownership and Acceptance of the Site’s Terms of Use

These Terms and Conditions of Use (“Terms of Use”) apply to the Mybo website located at mybomanagement.com and to all associated websites, subsidiaries, and affiliates. The Site is owned by Mybo.

Mybo reserves the right to change, modify, add, or remove portions of these Terms of Use at its sole discretion and at any time. Users are responsible for reviewing the Terms of Use periodically to check for updates. Continued use of the Site following the posting of changes will constitute your acceptance of those changes. Provided that the user complies with these Terms of Use, Mybo grants a personal, non-exclusive, non-transferable, limited right to access and use the Site.

CONTENT

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, and other materials (collectively, “Content”) on the Site — including, without limitation, the design, structure, selection, coordination, expression, look, and arrangement of such Content — are owned or licensed by Mybo and are protected by trade dress, copyright, patent, and trademark laws, as well as various other intellectual property and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Site or its Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, server, website, or other medium for publication or distribution or for any commercial purpose, without Mybo’s prior written consent.

 

Users may use Mybo product and service information (such as product sheets, knowledge base articles, and similar materials) intentionally made available for download from the Site, provided that:

– no proprietary notices are removed from document copies;

– such information is used solely for personal, non-commercial informational purposes and is not copied or posted to any networked computer nor broadcast in any media;

– no modifications are made to the materials;

– no additional representations or warranties are given relating to the documents.

USE OF THE SITE

Users may not use “deep linking,” “page scraping,” “robots,” “spiders,” or any other automatic device, program, algorithm, or methodology — nor any similar or equivalent manual process — to access, acquire, copy, or monitor any portion of the Site or Content. Users may not attempt to gain unauthorized access to any part of the Site, to any Mybo server, or to any services offered via the Site through hacking, password mining, or any other unlawful method.

ACCOUNT, PASSWORD, AND SECURITY

Certain features or services offered on or through the Site may require the creation of an account and password. Users must immediately notify Mybo of any unauthorized use of their account or password, or any other breach of security.

Users may not, at any time, use someone else’s Mybo account or password without explicit permission from the account holder. Mybo is not liable for any loss or damage arising from user non-compliance with these obligations.

PRIVACY

Users acknowledge that internet transmissions are never completely private or secure, and that any message or information sent to the Site may be intercepted or read by others, even if a notice indicates that a particular transmission (e.g., credit card details) is encrypted.

Mybo does not warrant that the Site or its content, services, or features will be error-free or uninterrupted, that defects will be corrected, or that use of the Site will yield specific results. Mybo cannot guarantee that files or data downloaded from the Site will be free of viruses, contamination, or destructive features. Mybo disclaims all warranties — express or implied — including warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose. Mybo is not responsible for acts, omissions, or conduct of third parties in connection with the use of the Site or Mybo’s services.

Users assume full responsibility for their use of the Site and any linked websites. If dissatisfied with the Site or its Content, the sole remedy is to stop using the Site. This limitation is a fundamental part of the agreement between the parties.

Mybo reserves the right at any time, without notice, to:

– modify, suspend, or discontinue functionality of the Site or any part of it;
– modify or change the Site, in whole or in part, and its related policies or conditions;
– suspend Site functionality for maintenance, error correction, or other changes.

LIMITATION OF LIABILITY

Except where prohibited by law, in no event shall Mybo be liable for indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if Mybo has been advised of the possibility of such damages.

If, notwithstanding the other provisions of these Terms of Use, Mybo is found liable to the user for any damage or loss arising out of or connected with the use of the Site or Content, Mybo’s liability shall not exceed:

– the total amount paid by the user for access to any Site service or feature during the six months preceding the claim; or
– €50.

Some jurisdictions do not allow limitations of liability; therefore, the above limitation may not apply to all users.

INDEMNIFICATION

Users agree to indemnify and hold harmless Mybo and its directors, officers, partners, successors, employees, agents, subsidiaries, and affiliates from any claims, losses, liabilities, or expenses (including legal fees) arising from or related to their use of the Site.

VIOLATIONS OF THE TERMS OF USE

Mybo may disclose user information (including identity) if it determines such disclosure is necessary in connection with investigations or complaints regarding improper use of the Site or to identify or take legal action against anyone interfering with Mybo’s rights or the rights of Site visitors.

Mybo reserves the right to disclose information as required by law, regulation, legal process, or governmental request.

JURISDICTION AND GOVERNING LAW

Any matter relating to access or use of the Site shall be governed by Italian law. Users agree to submit to the exclusive jurisdiction of the Court of Bergamo. If a user resides outside Italy, they may file a claim in their home jurisdiction.

MISCELLANEOUS

Mybo operates and manages the Site from its headquarters in Italy. Some products or services may not be available outside the European Union. Mybo reserves the right to limit access to the Site’s features or services at its discretion.
